These Terms of Service ("Terms") form a binding agreement between you and Quitzen Studio LLP, a Limited Liability Partnership registered in India (LLPIN: ACY-6551; PAN: AABFQ4719M), with its registered office at B-7 Sarvodaya Vilas, Kuldeep Vihar, 1st Floor, Quarsi Police Station, Aligarh – 202001, Uttar Pradesh, India ("Quitzen", "we", "us", or "our").
These Terms govern your access to and use of Nicoxit — our mobile application, website at nicoxit.app, related content, tools, AI features, and services (together, the "Service").
By creating an account, accessing the Service, or clicking "I agree", you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy, and our Health & Wellness Disclaimer. If you do not agree, do not use the Service.
1. About Nicoxit — What We Are, What We Are Not
Nicoxit is a 7-day educational, behaviour-change course delivered through a mobile application. It is designed to help adults examine the beliefs that keep them reaching for nicotine — across cigarettes, vapes, hookah, IQOS, and similar products — and to build the identity and tools that make continued use feel unnecessary.
Nicoxit is:
- An educational and self-development product.
- A guided programme rooted in mindfulness-based cognitive research and identity-focused behaviour change.
- A wellness companion that offers audio modules, exercises, tools, trackers, and an in-app AI coach.
Nicoxit is NOT:
- A medical device, medical service, or pharmaceutical product.
- A substitute for advice, diagnosis, or treatment provided by a qualified healthcare professional.
- A regulated smoking-cessation therapy (such as nicotine replacement therapy, prescription medication, or licensed counselling).
- A crisis or emergency service.
You must read and accept our separate Health & Wellness Disclaimer, which forms part of these Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age;
- Be legally capable of entering into a binding contract under the Indian Contract Act, 1872 (or the equivalent law of your jurisdiction);
- Not be barred from using the Service under any applicable law; and
- Provide accurate, current, and complete information when you register.
We do not knowingly collect information from or offer the Service to anyone under 18. If we learn that a user is under 18, we will terminate the account and delete associated data.
3. Your Account
You are responsible for:
- Keeping your login credentials confidential;
- All activity that happens under your account;
- Notifying us immediately at support@nicoxit.app if you suspect unauthorised access.
We may suspend or terminate accounts that we reasonably believe have been compromised, or that violate these Terms.
You may close your account at any time from within the app. Closure ends your right to use the Service and, subject to statutory retention obligations, initiates deletion of your personal data as described in our Privacy Policy.
4. The Free Tier and Paid Subscription
Nicoxit is offered on a freemium basis.
4.1 Free tier
The free tier gives you access to Day 1, Modules 1 through 3 and to a defined set of always-available tools (for example, Urge Surfing, Bubble Burst, and the Habit Tracker), as described within the app. Content beyond this is behind a paywall.
4.2 Paid subscription
Access to the full 7-day course and premium features requires a paid subscription (the "paid tier"). The current price, billing frequency, features, name of the tier, and any promotional offer are displayed at the point of purchase, in the app, or on nicoxit.app. The price and terms shown at checkout control. We may change pricing for future billing periods with reasonable prior notice; any change will not affect the billing period already paid for.
4.3 Payment channels
You may subscribe through:
- Apple App Store (in-app purchase governed by Apple's standard terms);
- Google Play Store (in-app purchase governed by Google Play's standard terms); or
- Direct payment on nicoxit.app through our payment gateway.
Where you subscribe through Apple or Google, that platform handles billing, receipts, renewals, cancellation, and refunds under its own rules. Our Refund & Cancellation Policy explains how each channel is handled.
4.4 Auto-renewal
Unless you cancel, subscriptions renew automatically at the end of each billing period at the then-current price. Cancellation must be made:
- Through Apple's subscription settings, for Apple purchases;
- Through Google Play's subscription settings, for Play Store purchases;
- Through your Nicoxit account page or by writing to support@nicoxit.app, for direct-web purchases.
Please cancel before the next renewal date to avoid the next charge. Apple and Google impose their own advance-cancellation windows for platform purchases (typically 24 hours before renewal); those windows govern App Store and Play Store subscriptions respectively. Cancellation stops future renewals; you retain access until the end of the current paid period. See our Refund & Cancellation Policy for full details.
5. Refunds — "Refund if You Don't Quit" Guarantee
Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.
In summary:
- The guarantee. If you complete the 7-day Nicoxit course as defined in the Refund Policy and are still using nicotine, you may request a full refund of your first subscription payment within 30 days of that first payment.
- First subscription only. Renewals are not eligible.
- One refund per person. Tracked across obvious account, device, payment, and IP linkages.
- Apple App Store subscribers. Apple handles all refunds under Apple's policies. We do not issue refunds through any side channel to Apple subscribers.
- Google Play and direct-web subscribers. We issue the refund directly, subject to the completion and eligibility conditions in the Refund Policy.

Nothing in these Terms limits any non-waivable statutory refund or cooling-off rights you may have under Indian consumer protection law.
6. Content You Create ("Your Content")
Nicoxit invites you to create personal content as part of the course. This may include your First Sentence, Belief Inventory, Awareness Logs, Journal entries, Breakup Letter, Anchor Statement, Future Self Letter, and other written or recorded reflections ("Your Content").
6.1 Ownership
You own Your Content. We do not claim any ownership of it.
6.2 Licence to us
You grant us a limited, worldwide, royalty-free, non-exclusive licence to host, store, back up, process, transmit, and display Your Content solely for the purpose of:
- Delivering the Service to you (including surfacing your entries later in the course, computing progress, and generating personalised AI Coach responses);
- Sending scheduled communications you have opted into — for example, delivering your Future Self Letter back to you at the intervals disclosed in-app at the time you seal it;
- Backing up and restoring your account; and
- Producing aggregated, de-identified analytics that cannot be linked back to you.
We will not use Your Content for advertising, sell it, publish it, or share it with third parties except as described in our Privacy Policy.
6.3 Your responsibility
You are responsible for the lawfulness of Your Content. You represent that Your Content does not violate any law and does not infringe any third-party right.
6.4 Deletion
When you delete an entry, or when you close your account, we will delete Your Content in line with our retention schedule. See our Privacy Policy.
7. Our Content and Intellectual Property
All content that we make available — including audio modules, scripts, exercises, tools, illustrations, videos, the "Verdant Calm" design system, the paper-craft botanical logo, the name "Nicoxit", the Borrowed Beliefs framework, and all related trade dress ("Nicoxit Content") — is owned by Quitzen Studio LLP or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access Nicoxit Content for your own personal, non-commercial use through the Service.
You may not:
- Copy, reproduce, mirror, distribute, publish, or make Nicoxit Content publicly available;
- Modify, translate, or create derivative works from Nicoxit Content;
- Reverse-engineer, decompile, or attempt to extract the source code of the Service;
- Sell, sub-licence, rent, or otherwise commercially exploit any part of the Service;
- Use Nicoxit Content to develop a competing product;
- Use automated systems (bots, scrapers, crawlers) to access the Service;
- Use the Service, its content, or any output of the AI Coach to train any machine-learning or artificial-intelligence model.
Any use of Nicoxit Content outside this licence requires our prior written permission.
8. In-App AI Coach
The Service may include an in-app AI coach powered by large-language-model technology (currently provided by Anthropic; see our Privacy Policy). The AI coach's name, as displayed in the app, controls.
By using the AI coach, you understand and agree that:
- It is an educational and reflective companion. It is not a therapist, doctor, counsellor, or licensed mental-health professional, and its responses do not constitute medical, psychological, legal, or financial advice.
- AI-generated responses can be inaccurate, incomplete, or out-of-date. You should not rely on the AI coach for anything safety-critical.
- Your prompts and messages to the AI coach are processed as described in our Privacy Policy. We take reasonable steps to prevent your content from being used to train third-party models, but we cannot guarantee the future behaviour of every provider.
- If the AI coach detects language suggesting a mental-health crisis, it will surface an escalation card with helpline contacts (see our Health & Wellness Disclaimer). If you are in crisis, contact a helpline or emergency services immediately rather than continue to chat with the AI coach.
- We may impose reasonable daily usage limits on the AI coach to keep the Service sustainable.
9. Acceptable Use
You agree not to:
- Use the Service in violation of any applicable law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023;
- Attempt to interfere with, disrupt, or gain unauthorised access to the Service or to the accounts of other users;
- Upload or transmit anything unlawful, obscene, defamatory, hateful, harassing, or that promotes self-harm or the harm of others;
- Impersonate any person, misrepresent your affiliation, or provide false information;
- Circumvent, disable, or otherwise interfere with security-related features;
- Use the Service to send unsolicited communications, chain letters, or spam;
- Introduce viruses, malware, or any other malicious code;
- Use the Service to make automated or excessive requests, or to scrape any content;
- Resell, redistribute, or provide the Service to third parties, whether commercially or otherwise.
We may investigate suspected violations and take any action we consider appropriate, including suspending or terminating access, and cooperating with law-enforcement authorities.
10. Referral Programme (If and When Offered)
We may — but are not obliged to — operate a referral programme through which you can earn credits (for example, additional days of paid access) when someone you refer becomes a paying subscriber, and the person you refer may receive a discount on their first payment. If we operate such a programme, its specific terms are published in-app and on nicoxit.app, and will include, at a minimum:
- Referral credits are promotional and have no cash value;
- Credits cannot be redeemed for cash, transferred, or combined with other offers unless we say so explicitly;
- Credits already granted are non-refundable and may be reversed if the referred user's payment is later refunded or reversed;
- We may cap, adjust, suspend, or end the programme at any time;
- Any misuse (self-referrals, fake accounts, fraudulent payments, coordinated abuse) will result in forfeiture of credits and may result in termination.
If no referral programme is live at the time you use the Service, this Section 10 has no effect.
11. Third-Party Services
The Service integrates with, or depends on, third-party services — including Apple App Store, Google Play Store, our payment gateway, email service providers, analytics providers, cloud-hosting providers, and Anthropic's large-language-model APIs. Your use of those services is governed by their respective terms. We are not responsible for the acts or omissions of third parties, but we choose our sub-processors carefully and disclose them in our Privacy Policy.
For purchases made through Apple App Store or Google Play Store, additional terms of those platforms apply, and those platforms — not Quitzen — are the merchant of record.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that:
- You have breached these Terms or any policy incorporated by reference;
- Continued access poses a risk of legal exposure to us or harm to other users;
- Continued access is technically or commercially impractical.
You may terminate at any time by deleting your account. Termination does not entitle you to any refund except as expressly stated in our Refund & Cancellation Policy. Sections that by their nature should survive — including Sections 6 (Your Content licence), 7 (IP), 13 (Disclaimers), 14 (Liability), 15 (Indemnity), 17 (Governing Law), and 18 (Grievance) — survive termination.
13. Disclaimers
The Service is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law:
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected.
- We do not warrant that use of the Service will produce any specific outcome — including that you will quit nicotine, remain abstinent, feel any particular way, or achieve any specific health, psychological, or lifestyle result. Individual outcomes vary and depend on factors we do not control.
- Any statement about results, testimonials, or research findings shown in the Service or in our marketing is educational and reflects the sources cited; it is not a promise or guarantee to you.
- Nothing in the Service is medical advice. See our Health & Wellness Disclaimer.
Nothing in this Section limits any rights you have under Indian consumer protection law that cannot lawfully be disclaimed.
14. Limitation of Liability
To the maximum extent permitted by law:
- Quitzen Studio LLP, its partners, employees, contractors, and affiliates will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or related to the Service or these Terms — even if we have been advised of the possibility of such loss.
- Our aggregate liability to you in connection with the Service or these Terms is limited to the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 1,000.
- Nothing in this Section excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our gross negligence, fraud, or wilful misconduct.
You agree that the limitations in this Section are a reasonable allocation of risk between you and us given the nature and price of the Service, and are essential to the basis of our bargain.
15. Indemnification
You agree to indemnify, defend, and hold harmless Quitzen Studio LLP, its partners, employees, and contractors from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of:
- Your breach of these Terms or any policy incorporated by reference;
- Your misuse of the Service;
- Your Content, including any claim that it infringes a third-party right or violates any law;
- Your violation of any law or of any right of a third party.
We may assume exclusive defence and control of any matter otherwise subject to indemnification by you, at your expense. In that case, you agree to cooperate with our defence.
16. Changes to the Terms
We may update these Terms from time to time. If we make a material change, we will give you reasonable notice — for example, by email or by an in-app notice — before the change takes effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree to the change, your remedy is to stop using the Service and, if applicable, cancel your subscription.
Non-material changes (such as clarifications, formatting, or corrections) take effect on posting.
17. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of India, without regard to conflict-of-laws principles.
Subject to Section 18 (Grievance), the courts at Aligarh, Uttar Pradesh, India have exclusive jurisdiction over all disputes arising out of or relating to these Terms or the Service. You consent to the personal jurisdiction of those courts.
18. Grievance and Contact
In line with the Digital Personal Data Protection Act, 2023 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to receive complaints from users.

19. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and Health & Wellness Disclaimer, constitute the entire agreement between you and Quitzen Studio LLP regarding the Service, and supersede all prior agreements.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent needed to make it enforceable.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of assets, or by operation of law.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including internet or platform outages, acts of government, natural disasters, or acts of war.
Notices. We may give you notice through in-app messaging, email to the address you registered, or by posting on nicoxit.app. Notices to us must be sent to support@nicoxit.app, with a copy to the registered office above.
By using Nicoxit, you confirm that you have read and agree to these Terms.
